15) Indemnity

You acknowledge that you are personally and exclusively responsible for your use of the Website and agree to indemnify, defend and hold harmless Treemo and its affiliates and subsidiaries, and all members, officers, directors, employees, attorneys, agents, successors, advisors, consultants, partners, visitors and third party information and service providers from and against any loss, damage, expense or liability of any kind (including attorneys' fees and costs) resulting from your (a) violation of these Terms of Use; (b) use of or access to the Website; (c) submission of User Submissions or other material or information or communication with Treemo; and/or (d) any act or failure to act by you.
